The Barnstable-based Cape Wildlife Center says the good Samaritan spotted the scuffle, recovered the stunned short-eared owl, and safely contained him until a rescue team arrived.

“Needless to say we were more than a little surprised when we opened the box and saw this endangered owl staring back at us,” the wildlife center said in a Facebook post.

The owl received a full evaluation and was determined to be healthy.

“His blood work, radiographs, and physical exam were all normal and he passed a flight test with flying colors. We suspect he was just a little stunned and disoriented following the attack,” the wildlife center added.

The owl has since been released back into the wild.

MSPCA: Bengal kitten who underwent successful surgery named Shakira because its ‘repaired hips don’t lie’ https://whdh.com/news/mspca-bengal-kitten-who-underwent-successful-surgery-named-shakira-because-its-repaired-hips-dont-lie/ Fri, 13 May 2022 16:13:01 +0000 https://whdh.com/?p=1497655 A Bengal kitten who recently underwent successful surgery has been named after the star singer Shakira because the feline’s “newly repaired hips don’t lie,” the MSPCA-Angell announced Friday.

Earlier this week, the MSPCA asked the public for help naming the rare exotic cat after a good Samaritan brought Shakira to the MSPCA in late April because she was unable to walk.

Veterinarians say Shakira underwent successful surgery to repair her pelvic fractures earlier this week.

“Hundreds of people chimed in across our various social media platforms, and we landed on a name for the exotic cat. She’s now called Shakira because, as some followers noted, her newly repaired hips don’t lie,” the MSPCA said in a statement.

The MSPCA noted that they are no longer accepting adoption inquiries. An adoption team hopes to place Shakira in a home in the coming days.

Most Bengal cats are brown or silver, but Shakira’s orange and gold color make her very unique.

DA: Police officer committed lewd act in family’s home while responding to reported disturbance https://whdh.com/news/da-police-officer-committed-lewd-act-in-familys-home-while-responding-to-reported-disturbance/ Fri, 13 May 2022 15:04:20 +0000 https://whdh.com/?p=1497613 (WHDH) — A police officer was arrested this week after he was caught committing a lewd act by a family who called 911 to a report a domestic disturbance at their California home, authorities said.

Matthew Dominguez, 32, of the San Jose Police Department, is slated to be arraigned next month on a misdemeanor indecent exposure charge, according to the Santa Clara County District Attorney’s Office.

“The charged behavior is beyond disturbing,” District Attorney Jeff Rosen said in a statement. “Law enforcement officers respond to our homes to help crime victims, not terrorize, traumatize, and create new victims.”

Dominguez, a four-year veteran of the force, responded to the home with two others officers on April 21 after receiving a report of a mentally ill family member who was being violent, the district attorney’s office said.

After initiating an investigation, authorities say Dominguez sent the other officers away to locate the ill person. He then allegedly started touching himself in front of female family members and exposed himself to the mother.

Dominguez has since been placed on administrative leave.

An investigation remans ongoing.

Police: Sexual assault kit initiative leads to arrest of Boston rape suspect https://whdh.com/news/police-sexual-assault-kit-initiative-leads-to-arrest-of-boston-rape-suspect/ Fri, 13 May 2022 13:00:59 +0000 https://whdh.com/?p=1497555 A Roslindale man was arraigned Friday after being linked through DNA evidence to an alleged incident of rape and is set to be arraigned for another on Monday, District Attorney Kevin Hayden said.

Irving Pierre, 40, of Roslindale was arraigned in the West Roxbury Division of Boston Municipal court in connection with a 2013 rape of a then-16-year-old.

According to a statement, prosecutors told the court that Pierre assaulted and raped the victim while in the Arboretum, causing her to be transported to a nearby hospital. At the hospital, DNA evidence was taken from the victim and entered into the FBI’s Combined DNA Index System.

In a separate case that Pierre will be arraigned for on Monday, the Roslindale man’s DNA was found was to be a match with evidence at a 2007 incident in which a 16-year-old female awoke to find her shirt removed. A sexual assault examination recovered evidence that the victim had not consented to sexual contact.

FBI found DNA evidence linking the two incidents in January and acquired a DNA sample from Pierre after naming him as a suspect.

“No matter how long ago an attack happened, we will continue to work on behalf of survivors to ensure justice on their behalf.  The victims of these assaults have waited years for answers, and today we have them as a result of the outstanding work of our partners at the Boston Police Department’s Sexual Assault Unit,” said Hayden in a statement.

Pierre is due back in court on Monday in the Dorchester Division of the Boston Municipal Court.

Berkshire, Franklin, Worcester, Middlesex, Norfolk, Essex, Suffolk, Plymouth, Dukes, Nantucket, and Barnstable counties are currently at a high risk level, according to the CDC.

Low, medium, or high risk levels are “determined by looking at hospital bed usage, hospital admissions, and the total number of new COVID-19 cases in an area,” the agency said.

Hampshire, Hampden, and Bristol counties are considered medium risk.

On Thursday, the Massachusetts Department of Public Health reported 5,576 new COVID-19 cases and 16 deaths. The state’s seven-day positivity has also increased to 8.24 percent.

There are currently 728 people hospitalized with the virus, 66 patients in intensive care units, and 27 intubated patients.

The state has reported 1,659,250 cases and 19,243 deaths since the start of the pandemic.

No bail for Alabama man facing murder charge in 1988 stabbing death of 11-year-old girl in Lawrence https://whdh.com/news/no-bail-for-alabama-man-facing-murder-charge-in-1988-stabbing-death-of-11-year-old-girl-in-lawrence/ Fri, 13 May 2022 10:53:23 +0000 https://whdh.com/?p=1497478 An Alabama man who was arrested earlier this week in connection with the 1988 stabbing death of an 11-year-old girl in Lawrence has been ordered held without bail.

Marvin C. McClendon, Jr., 74, of Breman, Ala., was extradited to the Bay State and arraigned Friday in Lawrence District Court on a charge of murder in the death of Salem, New Hampshire, native Melissa Tremblay, according to Essex District Attorney Jonathan Blodgett.

On Sept. 12, 1988, Tremblay’s body was discovered in the former Boston & Maine railway yard near Andover Street and South Broadway in Lawrence. Investigators say she had been stabbed to death and then run over by a train.

Police later determined that Tremblay had accompanied her mother and mother’s boyfriend to the LaSalle Social Club on Andover Street one day earlier. While the couple remained inside the club, investigators say Tremblay played in the adjacent neighborhoods and was last seen by a railroad employee and pizza delivery driver during the late afternoon hours.

Tremblay was reported missing later that evening after her mother and mother’s boyfriend frantically searched the area.

Scores of witnesses, suspects, and persons-of-interest were interviewed by police over the years, but evidence recently recovered from the victim’s body was instrumental to solving the case, according to Blodgett’s office.

McClendon is said to have lived in Chelmsford in 1988 and had multiple ties to Lawrence. An investigation revealed that he also worked and frequented establishments in the city.

Essex Victim Advocates contacted surviving members of Tremblay’s family on Wednesday night and notified them that the Cullman County Sheriff’s Office in Alabama had taken McClendon into custody.

Assistant district attorneys and state police detectives assigned to Blodgett’s office had been working on this cold case since 2014.

Joanne Zephir, 36, was arrested Sunday on charges of attempted murder and aggravated battery, according to Osceola County Sheriff Marcos R. Lopez.

Deputies responding to a report of a suspicious incident on Old Pleasant Hill Road in the Poinciana area around midnight found Zephir unconscious in the driver’s seat of her car, a 3-year-old girl unconscious in the back seat, and an 8-year-old girl in the roadway near the entrance to a church, Lopez said during a news conference.

Zephir and her children were taken to the hospital, where the 3-year-old was pronounced dead. The 8-year-old was released into the custody of a family member.

Zephir later confessed to making her daughters drink bleach from a “makeshift drinking glass” because someone had put a “voodoo spell” on her, Lopez said.

Lopez noted his office is waiting for official word from the medical examiner’s office before filing a murder charge against Zephir.

‘Terrible tragedy’: Baker announces $56M settlement with families affected by COVID outbreak at Holyoke Soldiers’ Home https://whdh.com/news/terrible-tragedy-baker-announces-56m-settlement-with-families-affected-by-covid-outbreak-at-holyoke-soldiers-home/ Thu, 12 May 2022 15:19:25 +0000 https://whdh.com/?p=1496976 Gov. Charlie Baker on Thursday announced that Massachusetts has reached a $56 million settlement in a class action lawsuit with families affected by a deadly COVID-19 outbreak at the Holyoke Soldiers’ Home in the spring of 2020.

“The COVID-19 outbreak at the Holyoke Soldiers’ Home was a terrible tragedy. While we know nothing can bring back those who were lost, we hope that this settlement brings a sense of closure to the loved ones of the veterans,” Baker said in a statement.

The agreement is subject to approval by the federal district court for Massachusetts.

Baker noted that the terms of the settlement will cover veterans who lived at the Holyoke Soldiers’ Home between March 1, 2020, and June 23, 2020, and who became ill or died from the virus during that period.

As part of the settlement, estates of deceased veterans would receive a minimum award of $400,000 and veterans who contracted COVID but survived would receive a minimum of $10,000.

Baker plans to file legislation seeking $56 million for the claims fund in the coming weeks.

An independent report ordered by Baker following the outbreak highlighted a series of “terrible errors” that were made by administrators. One staffer told investigators that she feared she was “walking vets to their death.”

At least 76 coronavirus-related deaths occurred during the outbreak.

MBTA: Shuttle buses will continue to replace Blue Line trains through next week https://whdh.com/news/mbta-shuttle-buses-will-continue-to-replace-blue-line-trains-through-next-week/ Thu, 12 May 2022 14:01:54 +0000 https://whdh.com/?p=1496937 Subway trains on part of the Blue Line will continue to be replaced by shuttle buses through at least early next week to allow crews to continue work on infrastructure updates in the Harbor Tunnel that will improve flood resilience and travel time, the MBTA announced Thursday.

Shuttle buses started replacing trains between Airport and Bowdoin stations on April 25. The disruption in service will now last through May 17 due to a construction tool cart that derailed earlier this week, according to transit officials.

In a statement, the MBTA said, “Due to the complicated area of track in the diversion area, a construction tool cart derailed near Airport station earlier this week. There were no injuries. The process to re-rail the tool cart earlier this week and make other repairs while continuing to finish scheduled work means additional time is needed to safely complete the project.

The shuttles will run all day, serve downtown stations in a one-way, outbound loop, drop off but not pick up riders at State station, and skip the Bowdoin station stop.

Riders who usually take the Blue Line from State or Bowdoin can transfer to the shuttles at Government Center. Express shuttles will not stop at Maverick.

The Silver Line 3 can be used as an alternative at Airport station for service to downtown Boston. Riders at Logan Airport should take the Silver Line 1 to South Station for service to downtown Boston.

The MBTA will also run special ferry service between Lewis Mall and Long Wharf North. Riders can show a CharlieCard or CharlieTicket to board.

Crews are working to replace 1,800 feet of track, inspect tunnel and drainage systems, seal leaks, and performing other preventive maintenance on the tunnel.

Prosecutors: Dad turned in son, attempted Burlington kidnapping suspect https://whdh.com/news/prosecutors-dad-turned-in-attempted-kidnapping-suspect-after-recognizing-son-in-video-of-woman-being-dragged-down-burlington-street/ Wed, 11 May 2022 19:16:01 +0000 https://whdh.com/?p=1496383 A man charged in connection with an attempted kidnapping that was caught on camera has been ordered to be held until his dangerousness hearing.

Tyler Healey, 23, was arraigned Wednesday in Woburn District Court on charges including attempted kidnapping, assault with attempt to rape, assault with intent to commit a felony, and indecent assault and battery on a person over the age of 14.

Healey, who has ties to Newton and Waltham, was arrested Tuesday in Winthrop and escorted into the Burlington Police Department in handcuffs after his father identified him from pictures released by the DPW as the suspect wanted in connection with an incident that took place on the side of the Middlesex Turnpike on Sunday night, prosecutors said.

Prosecutors noted that police were able to link Healey to the crime because police recognized the colorful, distinctive sneakers he was wearing in the surveillance video. He was also said to be wearing them when he was arrested.

https://twitter.com/KimberlyBookman/status/1524498113192501248

Officers launched an investigation after they received a 911 call from a woman who said she was driving home from work when she believed she saw another woman being dragged away on foot by a male suspect shortly before 8:30 p.m., according to Burlington Police Chief Thomas Browne and Middlesex District Attorney Marian Ryan.

During the attack, Healey allegedly groped the victim and pulled off her shirt. Healey then fled on foot and climbed over a fence at the public works department after a good Samaritan pulled over to assist the victim and called 911, according to investigators.

In the 911 call, the victim confirmed that she didn’t know the suspect. Video of the attack showed her scrambling to break free. She was ultimately able to get away and police located her upon arrival moments later.

“I really have to thank the victim in this case and the 911 caller,” Browne said. “The victim, as I’m sure you’ve seen in the video, put up the fight of her life.”

The victim, who wished to remain anonymous, told 7NEWS that she was leaving work when she noticed him following her. She said she did her best to fight him off because she feared for her life. She suffered bumps and bruises but she was not seriously injured.

She added that she is now afraid to leave her apartment.

Investigators said they believe the attack was random.

“What I’m hoping this does is serve as a wakeup call for all of us, myself included,” Browne said. “We need to be vigilant. This was a crime of opportunity and we need to make sure we take these opportunities away from people like that.”

Healey will be called back to court for a dangerousness hearing next week. He has other open cases in both Waltham and Framingham.

The incident remains under investigation.

Boston ranked among most sleep-deprived cities in United States https://whdh.com/news/boston-ranked-among-most-sleep-deprived-cities-in-united-states/ Wed, 11 May 2022 15:25:55 +0000 https://whdh.com/?p=1496320 It turns out Boston is the city that never sleeps, not New York City, according to a new study.

Researchers at Harmony Healthcare IT recently analyzed Google Trends and identified the most popular sleep-related questions tired Americans search for online in an effort to better understand the biggest sleep concerns from coast to coast.

The most sleep-deprived cities in the country were Boston, Las Vegas, Baltimore, Denver, and Seattle, researchers said. The least sleep-deprived cities were Chicago, New York City, Phoenix, Los Angeles, and San Antonio.

People in the Bay State also searched “how to fall asleep” the most when Googling about sleep issues, according to the study. The most commonly searched for term nationwide was “insomnia.”

Researchers also spoke with 1,100 people and learned that nine out of every 10 of them have trouble falling asleep, with more than 50 percent admitting they struggle to sleep at least once a week.

The extensive investigation, dubbed “Operation Shore Thing,” resulted in the seizure of about 1,950 grams of fentanyl, 4,310 oxycodone tablets, 51 grams of crack cocaine, two illegal firearms, and $75,000 in cash, Bristol District Attorney Thomas M. Through their efforts, a heavy volume of illegal narcotics that fuel pain, death, and addiction were taken out of circulation, and the crew who profited from the misery that their product inflicted on others now face justice.”

The following people are facing charges in connection with the investigation:

Woman dead, suspect in custody after armed standoff near Falmouth school https://whdh.com/news/woman-dead-suspect-in-custody-after-armed-standoff-near-falmouth-school/ Tue, 10 May 2022 16:40:54 +0000 https://whdh.com/?p=1495736 Police found a woman dead and took a man into custody Tuesday after a tense hours-long standoff near a Falmouth elementary school came to an end.

The North Falmouth Elementary School was placed in lockdown around 10:45 a.m. after officers received reports of gunshots fired inside an Old Main Street home, according to the Falmouth Police Department.

“We were told by family members that there may be a victim inside,” said Police Chief Edward Dunne.

As officers approached, they said 24-year-old Tyler James Gibbs was waiting outside and armed.

“At some risk to themselves, they entered the house in question to find a victim they had been told had been shot,” Cape and Islands District Attorney Michael O’Keefe said.

Out of concern for the safety of those living nearby, neighbors were temporarily evacuated from their homes and the students were dismissed early from the school.

“They just said, ‘You have to come now.’ So, I walked out and you see police with guns, one the ground pointing a the house, so it was pretty scary,” said neighbor Barbara Fagan.

Twenty-year-old Kianna Barrows was found dead in an upstairs bedroom inside her family home. A GoFundMe has been created for Barrows’ funeral expenses.

Gibbs was taken into custody, and the investigation remains “very active,” police said. He will be facing a murder charge in connection with the incident, authorities said. Investigators say he and Barrows were known to each other.

The Massachusetts State Police Detective Unit assigned to the district attorney’s office is leading the investigation, with Falmouth police detectives assisting.

Suffolk Construction resumes work at Boston sites following collapse, worker fall https://whdh.com/news/suffolk-construction-resumes-work-at-boston-sites-following-collapse-worker-fall/ Tue, 10 May 2022 14:12:38 +0000 https://whdh.com/?p=1495641 Suffolk Construction has resumed work at its sites in Boston, just days after a catwalk collapse in South Boston and an incident involving a worker who fell at a building in the South End.

The company voluntarily paused work at its sites across the city last week to conduct a “safety stand-down” to review.

Suffolk is the general contractor in charge of the demolition of the 1898 Boston Edison Power Plant in South Boston, which is part of a 1.7 million square foot mixed retail, residential, and office complex. Officials said a catwalk collapsed Wednesday on three workers during demolition. While two were freed quickly, one was trapped for three hours, with his legs stuck under piles of debris.

On Thursday, a crew member at one of the company’s construction sites in the South End was also hurt when he fell while working, according to authorities.

Suffolk District Attorney Kevin Hayden said his office was investigating but found no immediate evidence of criminal conduct.

Federal investigators from the Occupational Safety and Health Administration are examining the site, and they say it will take six months to complete their probe.

Some Mass. school districts recommend students, staff mask up amid rise in COVID-19 cases https://whdh.com/news/some-mass-school-districts-recommend-students-staff-mask-up-amid-rise-in-covid-19-cases/ Tue, 10 May 2022 11:12:38 +0000 https://whdh.com/?p=1495537 Some Massachusetts school districts are once again urging students and staff to wear masks while indoors amid a recent rise in new COVID-19 cases.

In a letter to the school community, Arlington Public Schools Superintendent Elizabeth C. Homan “strongly” recommended mask-wearing, except while eating or drinking.

Homan noted that the recommendation comes after the CDC designated Middlesex County as being high risk for virus transmission. New cases across the district also reached 159 last week, the highest count since early in the Omicron surge.

School officials in Belmont and Cambridge have also recommended a return to indoor mask-wearing, the Boston Globe reported.

The Department of Elementary and Secondary Education announced more than 8,000 new COVID-19 cases among students and more than 2,500 cases among staff last week.

Half of the counties in the state now have a high risk for COVID-19 transmission, according to the CDC.

On Monday, the Massachusetts Department of Public Health reported 8,625 new COVID-19 cases.

The state’s seven-day positivity has also increased to 6.77 percent.
